Germany Becomes First Major European Country to Legalize Weed

Germany has legalized possession and home cultivation of recreational marijuana, but will only allow sales through non-profit “social clubs” with limited membership. The Bundestag, Germany’s parliament, voted 407-226 today in favor of the legalization measure. The law, when it takes effect, will allow possession by adults (age 18 and over) of up to 25 grams of cannabis in public spaces, and up to 50 grams in private homes. Up to three plants can be grown in each household. Possession and use could be legal as early as April 1, although that date may be pushed back, according to Marijuana Moment. The bill now goes to the Bundesrat, the German legislative body that represents German states, and it could be referred to a mediation committee, which would delay final adoption of the law. Despite the good news, German cannabis enthusiasts shouldn’t expect a large legal marketplace anytime soon. The bill’s sponsors were forced to curtail plans for sales in licensed dispensaries and pharmacies because of European Union concerns, according to the BBC. The bill instead creates a plan for non-profit “cannabis social clubs” that will grow and distribute cannabis to a maximum of 500 members per club. These clubs could begin operations as early as July, depending on progress of the bill in the Bundesrat. According to Marijuana Moment, there are plans to introduce another bill that would establish pilot programs for commercial sales in some German cities. That legislation must first be reviewed by the EU’s European Commission. Conservatives in the Bundestag have said they will scrap legalization altogether if they take power in next year’s elections, according to the BBC. Germany will become the ninth country to legalize recreational cannabis use, and just the third European Union member (Luxembourg and Malta are the others). Canada, Georgia, Mexico, South Africa, Thailand and Uruguay have also legalized marijuana possession and use. Twenty-four U.S. states, the District of Columbia, and three territories have legal weed.

He also suggests studying air quality in public places, such as restaurant terraces, to target restrictions on tobacco products.Cuevas believes that if independent research, such as that conducted by Spanish universities, concludes that nicotine products cause damage to air quality, they will fully support greater restrictions. He also emphasizes that according to their understanding, e-cigarettes and heated tobacco do not generate secondhand smoke and have no impact on non-smokers.Finally, Cuevas said that as a company, they are keen on eliminating the worst nicotine products and moving towards better alternatives that do not involve combustion. He expressed his confidence that public health workers will ultimately recognize that countries like Sweden, which have implemented prevention policies and smoking cessation policies, as well as supported the development of better alternatives, are leading the way globally.

Elcaribe reported on the 19th that the latest report by the Latin American Reduction of Tobacco Harm Network (RELDAT) reiterated the view that e-cigarettes are clearly safer than traditional cigarettes in terms of health risks. RELDAT is composed of medical professionals from Mexico, Argentina, Ecuador, Brazil, Chile and other countries who are committed to successfully implementing policies to reduce harm related to smoking. The report stated that e-cigarettes are significantly safer than traditional cigarettes, and although not completely harmless, they provide adult smokers with a lower-risk alternative. The report explained that the "vapor" produced by e-cigarettes contains only about 1-2% of the compounds known to be in tobacco smoke, and is significantly less toxic than traditional cigarettes. Roberto Sussman, a researcher from Mexico, pointed out that compared to the combustion process, the "vapor" produced by e-cigarettes has significantly lower complexity and toxicity. This is because e-cigarettes produce "vapor" by heating a liquid mixture (including propylene glycol, glycerol, nicotine, water, and flavorings) rather than burning it, with a temperature much lower than the combustion process (180-270 degrees Celsius). The "vapor" particles from e-cigarettes are liquid droplets, with very low toxicity in their chemical composition. The report by RELDAT also discussed the role of e-cigarettes in adult smokers who continue to smoke. They emphasized that although most Latin American countries' healthcare systems do not provide alternative options for smokers, this situation will change in the future. At the same time, even if these alternative options are available, smokers have long used e-cigarette devices with nicotine supplies as part of a harm reduction strategy. The authors of the report, doctors, recommended that experts and health associations responsible for developing public health policies related to smoking should step out of their comfort zones and make decisions based on scientific evidence, always prioritizing the interests of patients, especially smokers. They should actively explore and research new tobacco control strategies, including promoting the use of new tobacco products such as e-cigarettes, to help smokers reduce their health risks.

The FDA sent warning letters today to seven online retailers, citing them for sales of novelty vapes that the agency says resemble “youth-appealing toys and drink containers.” According to FDA Center for Tobacco Products Director Brian King, the products “can be easily concealed and contain nicotine, which is highly addictive and can harm the developing adolescent brain.” The FDA regularly goes after novelty vapes, which make up a tiny piece of the worldwide vape industry. Most vaping consumers buy products they know will work, and novelty vapes don’t inspire confidence among people who count on vape products to avoid smoking. Novelty products aren’t made by well-known vaping manufacturers. For the FDA, vapes shaped like miniature soda bottles and tiny replicas of 1980s-style cell phones create an opportunity to show off the agency’s regulatory might and supposed concern for the well-being of the nation’s children. “The products’ design may also help youth conceal the e-cigarettes from adults or be confused with an everyday object and the contents accidently ingested by young children,” the FDA said in a press release. But how young would a child have to be to mistake a three-inch “drink container” vape for an actual Slurpee? In August, the FDA warned 15 retailers and distributors for selling products similar to those cited today. Last November, the agency sent letters to five manufacturers of “confusing” novelty vapes. One of those was a manufacturer selling a video game-lookalike novelty vape that had already received a warning letter more than two years earlier. Since it granted itself regulatory authority over the vape market in 2016, the FDA has authorized U.S sale of just seven e-liquid-based vapes—six of which are still available. The agency has not authorized any bottled e-liquid, open-system (refillable) vapes, or vaping products in flavors other than tobacco. The FDA has rejected premarket tobacco applications (PMTAs) for millions of vaping products, forcing many companies to challenge the agency's decisions in federal courts. Recipients of warning letters have 15 working days to respond, describing the corrective actions they’ve taken or disputing the agency’s allegations. Those who don’t reply may face additional FDA sanctions.

According to a report by South Korean media outlet Hani on September 20th, the sales of tobacco heating non-combustible electronic cigarettes have surged 6.8 times in the domestic market. Compared to traditional tobacco cigarettes, e-cigarettes are generally believed to have a smaller impact on health and even help with smoking cessation.    Lee Seong-gyu, the director of the Tobacco Control and Education Research Center in South Korea, released the research findings on the "Current Status and Usage Patterns of E-cigarettes in South Korea" at a smoking cessation policy forum hosted by the Ministry of Health and Welfare on the 20th. According to the study, sales of tobacco heating non-combustible electronic cigarettes in the domestic market increased from 78.7 million boxes in 2017 to 538.6 million boxes last year, a growth rate of 6.8 times. Only 292.6 million boxes were sold in the first half of this year (January to June), and it is projected that the annual sales volume will exceed 600 million boxes for the first time. In contrast, sales of traditional tobacco cigarettes decreased from 3.4447 billion boxes in 2017 to 3.0909 billion boxes last year, a decline of 10.3%. Tobacco heating non-combustible electronic cigarettes use rechargeable batteries to generate enough heat to inhale nicotine without producing smoke, unlike traditional tobacco that requires combustion.    The survey shows that smokers generally believe that e-cigarettes have less adverse effects on health. According to a survey conducted by Lee Seong-gyu from November 7th to 17th last year, involving 8,000 respondents aged 20 to 69 nationwide, among those who use tobacco heating non-combustible electronic cigarettes, 26.6% believe that the "indirect smoking risks are relatively low". Furthermore, 18.2% believe that it has "a small impact on health" and 14.2% believe that it "helps with smoking cessation". However, among non-smokers who have never smoked, 16.5% and 11.5% respectively hold the views that tobacco heating non-combustible electronic cigarettes have "relatively low indirect smoking risks" and "a small impact on health". Director Lee Seong-gyu pointed out, "The tobacco industry's marketing and other means have spread unverified information claiming that e-cigarettes do not contain harmful substances. Therefore, when formulating tobacco control policies, various smoking behaviors need to be considered, not just traditional smoking."    In 2018, the South Korean Ministry of Food and Drug Safety issued a report on the analysis of emissions from some domestically sold tobacco heating non-combustible electronic cigarettes, stating that "taking into account the results of international research such as the World Health Organization, it cannot be proven that tobacco heating non-combustible electronic cigarettes are relatively less harmful than traditional tobacco". The report also pointed out that they contain carcinogens such as benzo(a)pyrene and benzene, which are similar to those found in traditional tobacco and may cause various diseases."
